The divorce process, explained like a neighbor would

A big part of this practice is simply walking people through what happens next. Here is the whole road, from the first phone call to the final signature.

  1. 01

    The free consultation

    We talk on the phone — usually 15 to 30 minutes. You tell me about the marriage, the kids, the property, and where your spouse stands. I tell you honestly whether this can be done as an agreed divorce and what it will take.

  2. 02

    Gathering your information

    Names, dates, addresses, children's information, a list of property and debts, and any retirement accounts or real estate. Nothing fancy — just accurate. This is the part that makes or breaks a clean decree.

  3. 03

    Drafting the petition and decree

    We prepare the Original Petition for Divorce along with the Final Decree that spells out your agreement: who keeps what, who pays what, conservatorship, possession schedule, child support, and any name change.

  4. 04

    Filing with the Frio County District Clerk

    The petition is filed in Pearsall and the case gets a cause number. From that filing date, the Texas 60-day waiting period begins.

  5. 05

    Your spouse signs the waiver

    Instead of formal service by a constable, your spouse signs a Waiver of Service in front of a notary. This is the step where cooperation matters most — and where I keep everything polite and neutral.

  6. 06

    Review and signatures

    You both review the decree. Nothing gets signed until you understand every paragraph. Changes are much cheaper now than they are after the judge signs.

  7. 07

    The prove-up hearing

    After day 60, the case is presented to the judge. In most agreed cases this is short and only one spouse needs to appear — often by submission or a brief hearing.

  8. 08

    After the decree

    Deeds, retirement orders, title transfers, refinancing deadlines, and updating beneficiaries. A divorce is not finished when the judge signs — it is finished when the paperwork behind it is done.

If the agreement breaks down

At any point in this process a case can turn contested. When that happens we shift gears — temporary orders, discovery, mediation, and trial in Frio County if it comes to that. Same attorney, same phone number.
